Terms of Service

These Terms of service constitute the contract between Wandify, an online platform (referred to as the "Platform", “We”, or the “Company”) and Users (referred to as “You” or “User”) during the provision of services (referred to as the “Services”) by the Platform.

The Platform provides Services for the search and selection of professionals in various fields, access to their business profiles.

By accessing and using the Platform's Services, you accept these Terms of Service, the Privacy Policy, and the Privacy Notice.

We reserve the right to change these Terms of Service. If you disagree with the current version, please cease using the Platform.

We provide the Services on an "as is" basis, without any guarantees of quality or suitability for specific purposes.

Definitions

  • Administrator: an authorized user with additional status and rights assigned by the Platform.
  • Cookies: small pieces of data transmitted from a website to the browser you are using, used to remember information about your actions and visits.
  • Course: a payment rate system for the purchase of additional Credits.
  • Database: a collection of data about professionals that the Platform receives from open sources and created by Authorized Users.
  • Credits: authorized access to a professional's personal data.
  • Personal Account: the part of the Platform created during registration that allows you to access the Platform's functions and manage the account.
  • Personal Data: any information that allows you to identify a user or a professional.
  • User Privacy Policy: a document outlining methods of collecting, processing, and storing user's personal data.
  • Privacy Notice: a document regulating terms of website and user-generated content, including professionals' rights regarding their personal data.
  • Professional: a person whose data is collected, posted, and stored on the Platform's site. This includes professionals from various fields.
  • Profile: a visual display of a professional's personal data and characteristics on the Platform's website.
  • Third Party: a person or organization other than the Company, User, or Professional.
  • Tariff: a payment rate system for the Platform's services.
  • User: a person visiting the site.
  • Authorized User: a user possessing a personal account on the site, including recruiters or engagement specialists.

Unless otherwise specified, the term "User" refers to both authorized users and visitors.

Consent: a voluntary, specific, informed, and unambiguous expression of will for the processing of personal data.

Provided Services

The Platform grants Users a non-exclusive, non-sublicensable, non-transferable, and limited right to use the Platform's functions during the provision of the Services.

The Platform provides Services including access to professional data, the ability to supplement professional data, and access to the search and filtering system on the Platform's website.

Registration/Authorization

Users create an Account on the Platform using the registration form, providing the necessary data. Multiple accounts are prohibited. Users are responsible for the confidentiality and security of their login and password.

Access Recovery

Users can restore access to their Account by contacting the support service. Failure to confirm access rights may result in a refusal to restore account access.

Deactivating Account

To delete an Account, Users can refer to the appropriate section in their Personal Account. Failure to make payment may result in account blockage or deletion.

Payment For Services

Users integrate their bank card into the payment service and payments are charged automatically. Users cannot cancel payments for the Tariff. Refunds for Services or additional Credits are not provided.

Credits

Users can purchase credits via various tariffs to access additional Profile data.

Credits not spent in the current billing period will not be transferred to the next billing period.

When switching to a new tariff, the transition itself will take place after the current tariff expires.

Payment for the next period is debited from the User's bank card automatically on the last day of the previous paid period.

In case of failure to receive payment, the Platform switches to a limited mode of operation, and will display only the first page of the search results.

Refunds

The Platform does not provide refunds for purchased credits or services. However, in certain exceptional circumstances, refund requests may be considered on a case-by-case basis.

Purchased credits are considered used once a Professional's data has been accessed. The Platform does not provide partial refunds for unused credits.

Platform's Rights

The Platform has rights including receiving payment, receiving reliable personal data, using Cookies and other tracking technologies, processing and disclosing personal data, blocking accounts for non-payment or violations, making changes to the platform's interface and functionality, and changing the Terms of Service, Privacy Policy, and Privacy Notice.

Platform's Obligations

The Platform is obligated to provide Users with the right to change Tariffs, reply to user requests, and provide the ability to search for professionals and supplement their data.

User Rights

Users have the right to access the Platform's services, search for professionals, deactivate their accounts, and change their Tariff.

User Responsibilities

Users must not transfer login and password information to third parties, ensure the confidentiality of their account, provide accurate personal data, be responsible for the accuracy of professional data they provide, not post illegal or purchased personal data, and not use the Platform for illegal actions.

User Does Not Have The Right To

Users do not have the right to use the database for obtaining loans or insurance, use personal data for purposes contrary to the Privacy Policy and Privacy Notice, distribute or transfer access rights, collect personal data through automation tools, make changes to the software, upload harmful data, bypass technical features, access software to create competing products, or use the account for illegal actions.

Intellectual Property Statement

The Platform owns all exclusive intellectual property rights to the Services and software. Users are responsible for the legality and accuracy of the personal data they provide and guarantee that it does not violate intellectual property rights.

Disclaimers

The Platform is not responsible for user actions resulting from a misunderstanding of the Terms of Service, assumes no liability for damages (including indirect or consequential damages), limits liability for claims related to platform use, does not guarantee the accuracy of professional data, and is not liable for hacker actions or unauthorized access.

User's Consent

Users confirm their age and agree to the processing of personal data, regular debits from their bank card, and other consents as requested by the Platform.

Applicable Rights

The relationship between the Platform and the User is governed by US law. Disputes will be considered in US courts after attempts at negotiation and mutual agreement.

Duration Of The Terms Of Service

These Terms of Service are valid until the termination of the relationship between the parties. The Platform can terminate the relationship and delete the Account if the User violates the Terms of Service.
